APPEAL OF SUMMARY CONVICTIONS

District Justice/Magistrate Sentence

A defendant who has been found guilty or who has plead guilty of a summary offense may file an appeal with the Court of Common Pleas.  There is a deadline of 30 days from the date of the District Judge's ruling.  Summary Appeal Forms are available in the office of the Clerk of Courts or the copy below may be completed.  Should the defendant wish to file an appeal more than 30 days after the District Judge's ruling, it will be necessary for the defendant to file a Petition Nunc Pro Tunc.  This is a request made to the Judge allowing the defendant to file for an appeal even though the deadline has passed.  An attorney can assist the defendant in filing the Petition Nunc Pro Tunc.  Information is also available in any law library.  A non-refundable fee of $63.50 is charged by the Clerk of Court for the filing of any summary appeal.  This fee is in addition to any costs and fines, which may be or may have been charged.  

 

APELACION AL VEREDICTO DE CULPABILIDAD

JUEZ DE DISTRITO/SENTENCIA DEL MAGISTRADO

Un  acusado que ha sido declarado culpable o que se ha declarado culpable  de una ofensa menos grave puede radicar una Apelacioń al Tribunal de Primera Instancia.  Hay una fecha límite de 30 dias de la fecha de la Resolución del Juez.   Los documentos de Apelación  están disponibles en la oficina de la Sección Criminal del Centro Judicial de York o puede tambien completar la forma que aparece al final de esta página.

En caso que  el acusado desee apelar despues de 30 días sera necesario radicar una Peticion Nunc Pro Tunc.  Esta es una Petición al Juez  en la cual se solicita le permita radicar la apelación a pesar de que la fecha límite haya pasado.  Un abogado puede asistir al acusado para presentar la Petición Nunc Pro Tunc.  Encontrará informacioń disponible en  cualquier Biblioteca de Derecho.

Para poder radicar su Apelación la misma tiene un costo sin devolución de 63.50 el cual sera cobrado en  la Sección Criminal de inmediato.   Este es un costo adiccional a cualquier costas o multas que usted tenga o haya tenido anteriomente.

Imprima  y complete la forma de Apelación.  Envie cinco (5) copias con cheque o giro postal pagadero al “YORK COUNTY CLERK OF COURTS” por la cantidad de $63.50.

Summary Appeals by mail…Financial Affidavit 

If you are unable to afford the $63.50 Summary Conviction Appeal filing fee, the filing fee may be waived by Order of the Court of Common Pleas pending sufficient evidence of inability to pay.  To demonstrate inability to pay defendants must complete a Financial Affidavit or an In Forma Pauperis (in FORM uh PAH per us) petition.

SUPERIOR COURT APPEALS                            

Appealing to The Superior Court of Pennsylvania
for a Common Pleas Court decision

YOU HAVE 30 DAYS FROM THE DATE OF SENTENCE TO FILE A NOTICE OF APPEAL TO SUPERIOR COURT 
in the Clerk of Courts Office

      ·        One original and two copies must be filed with the Clerk of Courts with filing fees of $74.00 payable to the York County Clerk of Courts AND a separate filing fee of $60.00 made payable to the Prothonotary of the Superior Court, or a petition for IN FORMA PAUPERIS (In the manner of a pauper). Permission given to an indigent or poverty-stricken individual to appeal without payment of court fees.

     ·       Once Superior Court receives the notice of appeal, they will assign their own case number to the case (MDA).

        The Common Pleas Judge, regarding the matter appealed in the Clerk of Courts Office, files an opinion. It is entered into the computerized case history and forwarded along with the entire original court record to the Superior Court.

·
       A decision will then be made in the Superior Court proceedings and the lower court will then be notified.
